Definition of Domestic Violence

Domestic violence occurs between the following:
  • members of the family
  • people who are living together
  • people who are in a romantic or dating relationship
Oftentimes, domestic violence occurs between a man and a woman who are living together - married or not married - with the woman being the victim in most cases. There are times when domestic violence involves the use of weapons, or properties being damaged. As time passes by, most often than not, there is an increase in the frequency and level of physical abuse. 

Misdemeanor or Felony

What can you consider as a Misdemeanor? What can you consider as a Felony ?


There are two factors to consider:
  1. Was there any weapon used? Ex: knife, gun, etc.
  2. Did you incur any injury that resulted in permanent physical damage?
If your answer to both questions is 'NO', then the battery is classified as a Misdemeanor. However, if your answer to the questions is 'YES', then that's the time that it is classified as a Felony.

Penalties
For Misdemeanor -  $1,000.00 (maximum fine) and/or a total of 180 days in jail.
It is the City Attorney's Office that prosecutes all misdemeanors that occur within the vicinity of Las Vegas.

Meanwhile, it is The Clark County District Attorney's Office that prosecutes all misdemeanors that occur outside the following cities:
  • Las Vegas
  • North Las Vegas
  • Henderson
  • Boulder City
  • Mesquite
It is also The Clark County District Attorney's Office that handles prosecution for all cases of Felony.
